When is an Independent Review Panel required?

An IRP is convened when a parent applies to have a governing board’s decision not to reinstate their child following a permanent exclusion reviewed. The application must be made within the statutory timeframe after the parent receives the governing board’s decision.

What does the Independent Review Panel review?

The panel does not rehear the original governing board meeting or make the exclusion decision again. It reviews the governing board’s decision-making process, including whether it was lawful, reasonable and procedurally fair.

Who should attend an IRP and what documents are needed?

Attendance will usually include the panel members, the school or trust representative, the parent and their representative where applicable, and an SEN expert where requested. The information pack should include the relevant exclusion papers, governing board minutes and decision letter, evidence considered, policies and any representations required for the review.
